Preface
The UAE has implemented laws and regulations to control and regulate the consumption of tobacco and tobacco-related products, including vaping, which refers to the use of electronic nicotine products.
This article aims to provide an in-depth understanding of the regulations regarding vaping in the UAE, as stated in Federal Tobacco Control Law No. 15/2009, Cabinet Decision No. 24/2013 and Federal Law No. 3 of 2016 on the Rights of the Child (Wadeema Law).
In the UAE, vaping is subject to regulations designed to safeguard public health and protect minors.
Federal Law No. 15/2009 on Tobacco Control:
Article 1:
The law defines a “tobacco product” as anything made from tobacco leaves, whether whole, chopped, or mixed with other substances.
This includes tobacco powder and any other mixture containing tobacco. Additionally, the law describes “tobacco use” as exposure to tobacco in different ways, such as smoking, inhaling, chewing, sucking or any other method by which people smoke or use tobacco.
Article 5: Prohibited Conduct
•Sell or attempt to sell tobacco, including vape products, to persons under 18 years of age.
•Smoking in a private vehicle in the presence of children under 12 years of age.
•Smoking in places of worship, educational institutions, health and sports facilities.
•Sells candy that resembles tobacco products.
•Banning the domestic sale of tobacco vending equipment and devices, including vapes.
•Strict regulation of tobacco and vape advertising.
• Smoking, including vaping, is prohibited in enclosed public places.
Article 7: Smoking in enclosed public places
•Smoking, including vaping, is strictly prohibited in enclosed public places.
• Competent authorities may designate specific smoking and vaping areas subject to conditions outlined in the implementing regulations.
Article 8: Smoking in Public Places
•Smoking, including vaping, is strictly prohibited in public places.
•Enforcement of these restrictions needs to be coordinated with the competent authorities.
Article 11: Cafes and Tobacco Services
•Cafes serving tobacco (including vapes) in or near residential buildings will be subject to special restrictions.
•Implement regulations and coordinate with authorities to determine licensing conditions and locations for the supply of tobacco and vaping.
Articles 13 and 16: Penalties for Breach of Regulations
•Individuals who violate the provisions of Article 5, paragraph 1, Article 5, paragraph 3, and Article 9 of this Law may face legal consequences.
• Penalties include a minimum term of imprisonment of one year and a fine of Dh100,000 to Dh1 million, or either of the two penalties.
• In the case of multiple offences, the minimum term of imprisonment increases to 2 years and the fine remains at least AED 1,000,000.
•For any violation, an immediate fine of AED 500 will be imposed for rectification.
•If rectification fails, the case may enter criminal prosecution proceedings.
•Criminal penalties include fines ranging from AED 3,000 to AED 10,000, with increased penalties for repeated violations
